We apply the following Terms & Conditions, which you automatically accept when you place an order on the Cucinaria Web Shop.

Please note that only the following Terms & Conditions apply when ordering via our Web Shop. We will only confirm exceptions in written form prior to placement of order.

1. Prices

Catalog prices are only valid for orders placed through the Internet. The prices include value added tax (VAT). For tax-free shopping (only outside of Germany) we require your VAT number. All offers are not binding The contract is binding once you receive from us a confirmation of your order. The confirmation is replaced by and/or invoicing of order.

2. Order

2.1 Authorized people can only place the order.

2.2 You can order from this catalog by phone, fax or e-mail. We cannot accept responsibility for incomplete or faulty transmission of orders.

2.3 Your personal data is strictly used for order purposes. We assure you that your personal data will not be disclosed to third Parties.

3. Shipment

3.1 Orders are shipped via UPS. Shipping fee for Germany up to 30kg is 5.50 EUR. Shipment within Europe is subject to an additional fixed fee of 5.00 EUR, not included are possible extra costs such as custom taxes. These will be paid by the receiver. For order under 25.00 EUR we charge a fixed fee of 5.00 EUR. Shipment to islands and express shipping will be charged separately. There is an extra 5.00 EUR fee for cash on delivery. Please read carefully our instructions regarding acceptance of delivery.

3.2 As far as the products are available we will ship the order via mail or parcel postal delivery service. We assume no responsibility for delivery delays unless we have confirmed a date in writing. In such cases we only assume responsibility for the free return of goods delivered too late.

3.3 Acceptance of delivery: Should you receive a product that is visibly damaged or you suspect of a defect (broken sounds) either return it or if you decide to accept it, make sure that you advise the damages right away at the time of delivery.

4. Payment

4.1 You can choose between following forms of payment.

4.1.1 Purchase against invoice: (only available if you are already a customer of Cucinaria). At the delivery of the order you will receive the invoice. Please pay the invoice within 14 days or we will be obliged to charge you the fixed European interest penalty plus an extra 5%. In such cases we reserve the right not to have to prove our additional financial loss.

4.1.2 Credit card payment We will charge your credit card within 7 days. Please send us your credit card number and expiry date.

4.1.3 Direct debit. The amount will be charged to your bank account within 7 days. In case of insufficient funds you authorize your bank to disclose to Cucinaria your current address.

4.1.4 Cash on delivery. Fees on cash on delivery incurred through the post office or employment of private delivery companies are charged to the customer.

4.2. Where justified Cucinaria reserves the right to check your personal data with the in house files and the official credit agencies.

5 Right of ownership

The goods remain in property of Cucinaria until full payment has been received and all conditions listed here have been fulfilled.

6 Exchange policy

We accept returns within 14 days of receipt of the order. Return the product in its original package and with the original invoice via parcel postal; where this is not possible just write to us and we will pick it up. To keep the deadline return the goods or ask us for assistance. Shipment to be paid by sender.

7. Guarantee

Damaged items should be claimed within 7 days of receipt. There is a legal guarantee of 6 months upon receipt of the items; we reserve the right to perform repairs free of charge. Cucinaria is not liable for manufacturer guarantee. We are not liable for damages that occurred due to incorrect handling or force majeure.

8. Court of jurisdiction

Where appropriate court of jurisdiction is Hamburg.

9. Non liability

Prices and descriptions of all items of this Web Shop have been put together in good faith by the Cucinaria team. However we cannot assume responsibility for mistakes, technical changes to the products or continuous availability of the items.

10. Legal terms

Only German law is applicable under total exclusion of EU purchasing regulations.
